ADDITIONAL INTERNAL INSURANCE (TSK)
TERMS AND CONDITIONS
Supplement to Agreement No. 08122025
Effective as of 08.12.2025

I. GENERAL PROVISIONS
1.1. Additional Internal Insurance (TSK) means mandatory internal insurance that covers mechanical damage to the vehicle body incurred by the Lessee as a result of a traffic accident (hereinafter referred to as a “Traffic Accident” or “TA”).
1.2. Purpose of TSK is to reduce risks by sharing vehicle repair costs between the Lessee and the Lessor.
1.3. Scope of application — TSK is valid exclusively within the territory of the Republic of Estonia and applies only to vehicles owned by Q Takso Veod OÜ that are used for passenger taxi services and economic activity.
1.4. TSK is not insurance within the meaning of § 426 et seq. of the Law of Obligations Act (VÕS), but an additional service provided within the framework of a vehicle rental service. TSK provided by the Lessor is not subject to insurance contract regulation, and insurance law provisions do not apply thereto.
1.5. These TSK Terms regulate exclusively the handling of insurance cases covered by TSK.
All cases to which TSK does not apply — regardless of the reason for suspension or loss of validity — shall be handled in full in accordance with Chapters VI–VIII of the Standard Terms, and liability shall apply in full pursuant to those chapters.

II. DEFINITIONS
2.1. Insurance event — a Traffic Accident (TA) resulting in mechanical damage to the vehicle body.
2.2. Deductible (excess) — an amount of EUR 600 payable by the Lessee for each insurance event (maximum liability for the first insurance event, which increases thereafter).
2.3. Mechanical damage — damage to the vehicle body, including cracks, scratches, fractures or other deformations caused by external impact as a result of a Traffic Accident.
2.4. Use contrary to purpose — use of the vehicle in races, for transportation of dangerous goods, or outside public roads, where such use is not provided for by the agreement or these Terms.

III. INSURANCE CONDITIONS
3.1. TSK covers exclusively mechanical damage to the vehicle body caused by a Traffic Accident.
3.1.1. TSK does not cover:
medical expenses of injured persons, damage to personal belongings inside the vehicle, loss of income (including downtime or business losses), natural wear and tear, corrosion, or interior damage unless such damage was caused directly by a Traffic Accident.
The Lessee shall submit:
3.2.1. photographs of the damage taken at the scene of the accident;
3.2.2. a mutual accident statement if a police report is not available;
3.2.3. dashcam recordings, if available;
3.2.4. notification of the damage within 24 hours by email to: info@qtakso.ee.

IV. FINANCIAL CONDITIONS
Deductible
4.1.1. In the first insurance event, the Lessee shall pay a deductible in the amount of EUR 600.
4.1.2. If the repair costs do not exceed the deductible applicable at the time of the insurance event, the Lessee shall pay only the actual costs incurred.
4.1.3. TSK does not cover towing costs from the accident scene.
Unauthorized repair
4.2.1. The Lessee is prohibited from carrying out repairs independently, except for temporary measures required to transport the vehicle to a repair facility.
4.2.2. In the event of unauthorized repair, a contractual penalty of EUR 300 shall apply, and the Lessor reserves the right to redo the repair and claim the full repair cost from the Lessee.
Increase of the deductible in case of repeated insurance events
4.3.1. For each Lessee, the maximum deductible under TSK increases by EUR 100 for each new insurance event registered in the name of that Lessee.
The increase is cumulative and unlimited and applies as follows:
4.3.1.1. first insurance event — EUR 600;
4.3.1.2. second insurance event — EUR 700;
4.3.1.3. third insurance event — EUR 800, etc.
The Lessor has the right to keep records of all insurance events related to a specific Lessee and to apply the increased deductible in all subsequent agreements in which TSK is used, including:
4.3.2.1. upon conclusion of new rental agreements;
4.3.2.2. upon amendment of existing agreements;
4.3.2.3. upon replacement of the rental vehicle;
4.3.2.4. regardless of the legal entity with which a new agreement is concluded, as the TSK service is provided by the vehicle owner — Q Takso Veod OÜ.

V. EXCLUDED CASES
5.1. TSK does not apply if:
5.1.1. the Lessee operated the vehicle under the influence of alcohol, narcotic or other similar substances, or refused to undergo testing upon lawful request;
5.1.2. the vehicle was operated by a person not designated as the Lessee in the agreement or not entitled to drive the vehicle under the agreement;
5.1.3. the vehicle was used contrary to its intended purpose (see Clause 2.4);
5.1.4. the Lessee failed to notify the Traffic Accident within 24 hours, in which case TSK coverage for that event is suspended and shall not be restored retroactively.

VI. USE OF GPS DATA
6.1. The GPS device installed in the vehicle records speed and movement trajectory.
6.2. The Lessee agrees that GPS data may be used to confirm or refute the occurrence of an insurance event, as well as in pre-trial and court proceedings.

VII. TSK FINANCING AND VALIDITY CONDITIONS
7.1. The base weekly TSK fee amounts to 5% of the weekly rental fee of the respective vehicle.
7.2. The Lessor has the right, at its sole discretion, to reduce the TSK fee based on an oral agreement with the Lessee, provided that the Lessee complies with the Lessor’s requirements. The Lessor also has the right to restore the TSK fee to 5%, subject to prior notice in accordance with Clauses 1.6–1.8 of the Cooperation Agreement.
7.3. TSK coverage is automatically suspended if weekly TSK payments are not paid in full and on time. Coverage is restored immediately upon payment but does not apply retroactively.
7.4. TSK coverage is suspended if the Lessee has not fully paid:
7.4.1. the current week’s rental fee in accordance with Clause 3.4 of the Cooperation Agreement;
7.4.2. 25% of the base rental fee specified in the handover–acceptance report in accordance with Clause 3.5 of the Cooperation Agreement;
7.4.3. the current week’s TSK payment.
7.5. If the security deposit is not fully paid, TSK coverage is suspended regardless of other payments and is restored only after full payment of the deposit, without retroactive effect.
7.6. TSK coverage is restored immediately upon payment and does not apply retroactively.
7.7. The existence of overall indebtedness does not exclude TSK validity provided that the conditions set out in Clauses 7.4.1–7.4.3 are fulfilled.

VIII. INTERPRETATION OF TSK TERMS
8.1. Circumstances of a Traffic Accident are assessed based on the evidence submitted and the principle of good faith. Failure by the Lessee to comply with the obligations set out herein may prevent objective determination of the circumstances and affect compensation.
8.2.1. The Lessee is obliged to take all reasonable and necessary measures to properly document and establish the circumstances of the Traffic Accident.
8.2.2. Failure to comply with such obligations constitutes a breach of the agreement and may result in:
8.2.2.1. suspension of TSK coverage for the respective event without retroactive restoration;
8.2.2.2. obligation of the Lessee to compensate damage in full in accordance with the Cooperation Agreement and the Standard Terms;
8.2.2.3. acceptance of the Lessor’s evidence as sufficient due to the Lessee’s inactivity.
8.2.3. Compliance with obligations is assessed in accordance with the principles of good faith and reasonableness pursuant to §§ 7 and 8 of the Law of Obligations Act (VÕS).
8.2.4. Improper documentation does not release the Lessee from contractual liability or from the obligation to compensate damage.
8.2.5. Submission of false information or concealment of information constitutes a material breach and results in suspension of TSK coverage for all related cases without retroactive restoration.

IX. DISPUTE RESOLUTION
9.1. All disputes shall be resolved by Harju County Court.

EXPLANATIONS AND APPLICATION
These TSK Terms apply automatically as an integral part of the vehicle rental agreement for taxi services and economic activity. All definitions, requirements and procedures set out herein are binding upon the parties and shall be interpreted and applied in accordance with the laws of the Republic of Estonia.
